Online Membership – Terms and Conditions

 1. General

The Centre for New Zealand Music Trust (SOUNZ) and you warrant both that:

• (a) this Agreement has been validly entered into and on execution shall impose valid and binding legal obligations upon SOUNZ and upon you; and
• (b) SOUNZ and you shall both perform obligations under this Agreement with reasonable care and skill.

 

2. Downloads

Scores, recordings or other materials available for download are subject to copyright, and members agree to the following terms for this service.

Scores and other documents purchased as a download

• 2.1 You are entitled to print as many as the same number of scores or documents of the digital file(s) as agreed upon at the time of purchase. You may undertake this action once only unless otherwise agreed with the Centre for New Zealand Music.
• 2.2 Digital file(s) of scores or documents must be destroyed in their entirety within 30 days of purchase.
• 2.3 No part of this digital file(s) may be reproduced, stored in a retrieval system, or transmitted in any form or by any means, electronic, mechanical, copying, recording or otherwise, without the prior permission of the Centre for New Zealand Music Trust or the appropriate copyright holder in any way other than that noted in 2.1 and 2.2

Recordings sold as download

• 2.4 The sale of recordings by download through the SOUNZ website is subject to a Licence with APRA and AMCOS and a portion of net income from sales is returned to copyright owners through that licence.
• 2.5 Recordings purchased by download are for sole personal and non-commercial use. You shall not have the right to and shall not in any way copy, alter, translate, broadcast, transmit, distribute, perform, publish, display, sell or otherwise deal with recordings purchased from the SOUNZ website.

 

3. Termination

Any abuse of privileges that come with Online Membership could result in immediate suspension of user privileges and the deletion without warning of your Login.

• 3.1 Reasons for termination include:
  

  • i)   Allowing other people to use his/her password to access the membership area of the SOUNZ website
  • ii)  Using discount privileges to buy on behalf of another person/ person/s who is/ are not a member of SOUNZ
  • iii)  Breaching any of the general Terms and Conditions of the use of this website

• 3.2 In these circumstances, SOUNZ advises that it is not obliged to refund any membership fees.

• 3.3 You may terminate this Agreement at any time by contacting SOUNZ.

• 3.4 Upon termination of this Agreement all rights granted and services provided to you shall immediately and automatically revert to SOUNZ and access to the SOUNZ website membership services shall immediately cease.

• 3.5 SOUNZ reserves the right at its sole discretion to restrict, suspend or terminate your access to the SOUNZ Membership services.

 

4. Changes in Services

SOUNZ reserves the right to modify the terms and conditions of this Agreement at any time and without notice. Accessing this site constitutes agreement with the modified conditions. You are accordingly advised to review this Agreement regularly.
